Terms & Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of haleeporter.com (the “Website”) and any products or services offered through it, including original artwork, prints, and commissioned artwork (collectively, the “Services”). The Website is owned and operated by Halee Porter, an individual artist based in the United States (“we,” “us,” or “our”).

By accessing the Website, placing an order, or commissioning a piece of artwork, you (“you” or the “Client”) agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not use the Website or our Services.

Please read these Terms carefully and save a copy for your records. We recommend reviewing them periodically, as they may be updated from time to time.

1. About

haleeporter.com is the personal website and online studio of Halee Porter. We sell original paintings, fine art prints and reproductions, and accept custom commission requests. The Website is hosted on the Wix platform; payment processing is handled by Wix’s PCI-DSS–compliant payment partners.

2. Use of the Website

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal, non-commercial purposes. You may view, browse, and print pages from the Website solely for your own personal reference.

You agree that you will not:

  • Republish, redistribute, reproduce, duplicate, copy, sell, rent, sub-license, or otherwise exploit any material on the Website for commercial purposes;

  • Edit, alter, modify, trace, or create derivative works from any artwork or content displayed on the Website;

  • Use the Website in any way that is unlawful, fraudulent, or harmful, or in connection with any unlawful or harmful purpose;

  • Transmit any virus, malware, or other malicious code via the Website;

  • Conduct any systematic or automated data collection (including scraping, mining, or harvesting) without our prior written consent;

  • Use the Website to transmit unsolicited commercial communications or for any marketing purpose without our express written consent.

3. Intellectual Property and Copyright

All artwork, images, text, graphics, designs, photography, logos, and other content displayed on the Website are protected by United States and international copyright law. Unless otherwise stated, Halee Porter owns or licenses all such intellectual property rights, and all rights are reserved.

Halee Porter retains all copyright and reproduction rights in every artwork — including originals, prints, and commissioned works — regardless of whether the physical artwork has been sold.

When you purchase an original painting, a print, or a commissioned piece, you acquire the physical object only. You do not acquire any copyright, reproduction rights, or licensing rights. You may not reproduce, scan, photograph for commercial use, distribute, publish, or create derivative works from any artwork purchased from us without our prior written permission.

We reserve the right to display photographs of any artwork (including commissioned work) on the Website, on social media, in marketing materials, in printed promotional items, and in our portfolio. If you commission a piece and do not wish for it to be shared publicly (for example, because it is a surprise gift), you must let us know in writing at the time the commission is placed.

Personal, non-commercial display of purchased artwork in your home or office is permitted. Resale of the original physical artwork is permitted, but the copyright and reproduction rights remain with Halee Porter.

4. Products and Terms of Sale

By placing an order through the Website, you make an offer to purchase the selected product subject to these Terms. All orders are subject to availability and to our acceptance. We reserve the right to refuse or cancel any order at our sole discretion, including in cases of suspected fraud, pricing or description errors, or stock unavailability.

4.1 Originals

Each original painting is one-of-a-kind. Colors shown on screen are reproduced as faithfully as possible, but slight variations between the on-screen image and the physical painting may occur due to differences in monitors, lighting, and individual perception. These variations are inherent to original artwork and are not considered defects.

4.2 Prints and Reproductions

Prints are reproductions of original works produced on the materials specified in each product listing. As with originals, slight color variation between the screen image and the printed product is normal. Prints are not signed limited editions unless explicitly described as such in the listing.

4.3 Custom Commissions

Custom commissions are governed by the additional terms in Section 7 below. By submitting a commission inquiry or paying a commission deposit, you agree to those additional terms.

4.4 Order Confirmation

When you place an order, you will receive an automated acknowledgement email. This email is only an acknowledgement of receipt and does not constitute acceptance of your order. A binding contract of sale is formed only when we send a separate email confirming that your order has been accepted and (where applicable) dispatched.

4.5 Pricing and Errors

All prices are listed in U.S. dollars and exclude shipping, applicable taxes, and any customs duties on international orders. While we take reasonable care to ensure that prices and descriptions on the Website are accurate, errors may occur. If we discover an error in the price or description of a product you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the corrected price or cancelling it. If we are unable to reach you, the order will be treated as cancelled and any payment already taken will be refunded in full.

5. Payment

Payment is processed at the time of order through Wix’s payment gateway. All transactions are handled by PCI-DSS–compliant third-party payment processors; we do not store full credit or debit card details on our systems.

By submitting payment information, you represent and warrant that you are an authorized user of the payment method used and that sufficient funds are available to cover the cost of the order.

6. Shipping

We ship within the United States and to most international destinations. Shipping costs and estimated delivery times are calculated at checkout and depend on the destination, weight, and value of the order. Originals and large prints are packed with care, but transit times are estimates only and may vary due to carrier delays, customs processing, weather, or other circumstances beyond our control.

International orders: You are responsible for any customs duties, import taxes, brokerage fees, or other charges imposed by the destination country. These charges are not included in the price or shipping cost shown at checkout. Refusal to accept delivery due to unpaid customs fees does not qualify the order for a refund of shipping costs.

Title and risk of loss for purchased artwork pass to you when the package is delivered to the carrier. We will provide tracking information where available. If your package is lost or damaged in transit, please contact us within fourteen (14) days of the expected delivery date so that we can assist you in filing a claim with the carrier.

7. Custom Commissions

The following additional terms apply to all commissioned artwork. Submitting a commission inquiry and/or paying a deposit constitutes your acceptance of these terms; a separate signature is not required.

7.1 Quotation and Acceptance

Each commission begins with a written quotation describing the subject matter, size, medium, estimated timeline, and total price. Quotations are valid for thirty (30) days from the date of issue. We reserve the right to alter or withdraw a quotation after that period.

7.2 Non-Refundable Deposit

A non-refundable deposit of fifty percent (50%) of the total commission price is required to confirm and reserve a commission slot. Work will not begin until the deposit has been received. The deposit is non-refundable under any circumstance, including if the Client cancels the commission, changes their mind, becomes uncontactable, or fails to provide required materials in a timely manner.

7.3 Reference Materials

For commissions involving a likeness (person, pet, or place), the Client must provide clear, high-resolution reference photographs. The Client warrants that they own or have permission to use any photographs they submit and that doing so does not infringe any third party’s copyright or other rights. The Client indemnifies Halee Porter against any claim arising from the use of supplied reference materials.

7.4 Progress and Approvals

During the commission, we may share work-in-progress images for feedback. Minor adjustments may be requested at the rough/mid-stage. Once the artwork is substantially complete, only very minor adjustments can be accommodated. We may share progress images on social media unless the Client has requested otherwise in writing at the time the commission is placed (for example, when the artwork is a surprise gift).

7.5 Final Payment and Delivery

The remaining balance is due in full upon completion of the artwork and before shipping or pickup. Once final payment is received and cleared, the artwork will be shipped to the address provided by the Client. We are not responsible for delays caused by incorrect addresses provided by the Client.

7.6 Copyright in Commissioned Work

Even in the case of a commissioned piece, Halee Porter retains all copyright and reproduction rights in the artwork. The Client receives the physical artwork only. Halee Porter may produce prints, license the image, and display the work on the Website, on social media, and in marketing materials, unless the Client purchases additional rights in writing at an agreed fee.

7.7 Cancellation and Termination

If the Client cancels a commission after the deposit has been paid but before the artwork is complete, the deposit will be retained in full. If the Client cancels after the artwork is substantially complete, we reserve the right to charge up to one hundred percent (100%) of the total commission price, at our discretion, based on the stage of completion.

If the Client fails to respond to communications for a continuous period of thirty (30) days, we will send a written reminder. If the Client does not respond within an additional thirty (30) days following that reminder, we reserve the right to cancel the commission. In that event, the deposit will be retained, any work already produced will remain our property, and any further commission would require a new quotation and a new non-refundable deposit.

8. Returns and Refunds

8.1 Commissions

All sales of commissioned artwork are final and non-refundable. Because each commission is created uniquely for the Client, we cannot accept returns or offer refunds once the work has been accepted and shipped.

8.2 Prints

Refunds or exchanges on prints may be considered on a case-by-case basis at our sole discretion. To request a refund or exchange of a print, please contact us within fourteen (14) days of delivery and include photographs of the item and packaging. We will most commonly approve requests where the print has arrived damaged or where the item received differs materially from the listing description.

8.3 Originals

Originals are considered final sales. In rare cases where an original is damaged in transit, please contact us within fourteen (14) days of delivery with photographs of the item and packaging so that we can work with the carrier on a claim and discuss next steps.

8.4 Method and Timing of Refunds

Approved refunds will be issued to the original payment method. Please allow up to ten (10) business days for the refund to appear on your statement after it has been processed.

9. User-Submitted Content

If you submit content to us — such as messages through the contact form, reviews, testimonials, or reference photographs for a commission — you grant Halee Porter a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce, adapt, and display that content in connection with the Website and our business (including in marketing materials and on social media), subject to our Privacy Policy.

You represent and warrant that any content you submit is your own (or that you have all necessary rights to grant the license above), is not unlawful, and does not infringe the rights of any third party.

10. Third-Party Links

The Website may include links to third-party websites, including social media profiles and the websites of galleries, stockists, or collaborators. We do not control these third-party sites and are not responsible for their content, privacy practices, or terms of use. Following any such link is at your own risk.

11. Disclaimers

The Website and all content on it are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Website will be available without interruption or error, or that the content will be complete, accurate, or up to date.

Nothing on the Website constitutes professional, legal, financial, or investment advice.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Halee Porter will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Website, any purchase made through the Website, or these Terms, even if we have been advised of the possibility of such damages.

In all cases, our total aggregate liability to you arising out of or in connection with the Website, any product purchased from us, or these Terms, will not exceed the amount you actually paid us in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for death or personal injury caused by negligence, or for fraudulent misrepresentation).

13. Indemnification

You agree to indemnify, defend, and hold harmless Halee Porter from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Website; (b) your breach of these Terms; or (c) your violation of any third-party right, including without limitation any copyright or other intellectual property right.

14. Changes to the Terms

We may revise these Terms from time to time. The revised version will take effect when posted on the Website, and the “Last updated” date at the top will be amended. Your continued use of the Website after changes are posted constitutes your acceptance of the revised Terms. Please review this page regularly to stay informed.

15. Governing Law and Disputes

These Terms, and any dispute arising out of or in connection with them or your use of the Website, will be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Hays County, Texas for the resolution of any such dispute.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be deemed severed from these Terms and will not affect the validity and enforceability of the remaining provisions.

17. Entire Agreement

These Terms, together with our Privacy Policy and any order confirmation we send to you, constitute the entire agreement between you and Halee Porter regarding your use of the Website and any purchase made through it, and supersede any prior agreements or understandings, whether written or oral.
